This Refund & Return Policy outlines the rights of consumers and the procedures for requesting refunds or returns for products purchased through this Application or official channels of Noble Crest Inc. (“we,” “us,” or “the Controller”).
This policy complies with:
European Union:
Directive 2011/83/EU on Consumer Rights (Consumer Rights Directive);
Italian Consumer Code (Legislative Decree No. 206/2005, as amended by Legislative Decree 170/2021);
Regulation (EU) 2018/302 on cross-border e-commerce;
Directive (EU) 2015/2366 – PSD2 (Payment Services Directive, for card & electronic payments);
GDPR (Regulation (EU) 2016/679).
United States:
Federal Trade Commission Act (15 U.S.C. §§ 41–58);
FTC “Mail, Internet, or Telephone Order Rule” (16 CFR Part 435);
California Consumer Privacy Act (CCPA, Cal. Civ. Code § 1798.100 et seq.);

This Policy applies to:
EU consumers, including payments via cash on delivery (COD) or credit/debit card;
U.S. consumers, limited to credit/debit card payments only.
In accordance with:
Articles 52–59 of the Italian Consumer Code (Legislative Decree No. 206/2005);
Articles 9–16 of Directive 2011/83/EU;
EU consumers have the right to withdraw from a contract within 14 calendar days of receiving the goods, without providing any reason.
To exercise this right, the consumer must:
Send a written request to admin@scalifypro.net;
Include full name, address, order number, and purchase date;
Return the product intact in its original packaging within 14 days of the withdrawal notice.
Return shipping costs are borne by the consumer unless otherwise agreed.
Refunds will be processed within 14 days of receiving the returned goods or proof of shipment, using the same payment method as the original transaction, in compliance with Article 56, Italian Consumer Code.
Under Articles 59–60, Italian Consumer Code, the right of withdrawal does not apply to:
Custom-made or personalized products;
Perishable goods or items likely to deteriorate quickly;
Digital content fully supplied before the withdrawal period expires, with prior consumer consent;
Sealed goods unsuitable for return due to health or hygiene reasons, once opened.
In compliance with:
FTC Rules (16 CFR Part 435);
California Civil Code §1723;
FDUTPA, Florida Statutes §501.201 et seq.,
U.S. consumers may request a refund within 30 days of purchase if:
The product is defective or damaged upon delivery;
The product does not match the description;
The order was incorrectly charged or not delivered.
Refund requests must be sent to admin@scalifypro.net and include:
Full name and postal address;
Order number;
Description of the issue and proof of purchase (receipt, screenshot, or invoice).
Refunds are processed within 10 business days from approval, via the original payment method, in compliance with 16 CFR 435.2.
EU Consumers:
Credit/debit card or cash on delivery (COD);
Payment handling compliant with PSD2 (Directive 2015/2366);
Secure processing through PCI DSS-compliant providers.
U.S. Consumers:
Payments accepted only via credit/debit card;
Secure processing in accordance with PCI DSS and applicable state consumer protection laws.
Refunds are credited using the original payment method unless otherwise agreed.
If the original method is unavailable (expired card), alternative arrangements will be made via written communication with the consumer.
All refund confirmations are sent electronically for record-keeping and legal compliance.
EU Consumers:
Governed by Italian law, per Article 66-bis, Italian Consumer Code;
Exclusive jurisdiction: courts of Italy;
Consumers are encouraged to contact admin@scalifypro.net before pursuing legal action.
U.S. Consumers:
Governed by Florida law, without regard to conflict of law principles;
Consumers should first contact admin@scalifypro.net for amicable resolution.
Personal data collected during refunds or returns are processed according to our Privacy Policy, GDPR, and CCPA.
Consumers may exercise their rights under:
Articles 15–22 GDPR (access, rectification, deletion, restriction, portability, objection, withdraw consent);
CCPA/State laws (access, deletion, opt-out of sale).
